Bail conditions in SA
The South African Constitution allows any arrested person to apply for bail, regardless of the charge. Bail allows an accused to be released from custody while waiting for trial under certain conditions.
There are three types of bail applications. Police bail (Section 59) is for less serious offences like petty theft or minor drug possession. It can be granted at the police station within 48 hours of arrest. Prosecutor bail (Section 59A) applies to more serious crimes, such as assault with intent to cause harm or fraud under R20,000. It must be approved by a prosecutor before the first court appearance. Court bail (Section 60) is for serious charges under Schedule 5 or 6, like murder or rape. A formal bail hearing is required in court.
When deciding on bail, the court considers whether the accused may flee, threaten others, interfere with evidence or disturb public order. If any of these risks exist, bail is denied. Once bail is granted, the accused must attend all court appearances. Failure to do so can lead to arrest and the revoking of bail.
